AI and intellectual property

More and more people are asking a chatbot to define their personality. Understandable, but a PCM Profile is only established through the official questionnaire and a conversation with a certified professional. Therefore, Kahler Communications, owner of the Process Communication Model®, has defined what is and is not permitted regarding PCM and AI. You can read the Dutch translation below.

This is a translation of the PCM AI & Intellectual Property Policy of Kahler Communications. In case of discrepancies, the English version applies.

PCM's AI and Intellectual Property Policy

The Process Communication Model® (PCM) is a methodology that is protected worldwide by intellectual property rights.

PCM, Process Communication Model® and the associated names, logos, materials and tools are the property of Kahler Communications and/or the parties it has authorized thereto. This protection applies to, among others, but not exclusively,:

  • the concepts, terminology, and didactic structure of PCM;
  • PCM questionnaires and assessment instruments;
  • PCM Profiles and reports;
  • PCM manuals, training materials, slides, videos, and certification content;
  • PCM accreditation and certification processes;
  • all confidential, restricted, or non-public PCM resources made available to certified professionals, distributors, partners, or customers.

Use of PCM content in AI systems

Non-public PCM content may not be uploaded, entered, copied, or processed without prior written permission from Kahler Communications. Furthermore, this content may not be used for prompting, training, fine-tuning, indexing, retrieval, or embedding, or otherwise incorporated into a public or private generative AI system, large language model, chatbot, assistant, agent, knowledge base, or machine learning tool.

This prohibition applies in particular to:

  • PCM manuals and slides;
  • certification and accreditation material;
  • trainer manuals;
  • questionnaires, scoring logic and questionnaire mechanisms;
  • PCM Profiles and the detailed content of reports;
  • videos, exercises and other protected teaching materials;
  • all confidential content accessible via PCM platforms or professional PCM communities.

Unauthorized AI tools and PCM impersonation

No chatbot, GPT, AI assistant, AI coach, automated scoring tool, application, or digital service may:

  • presenting themselves as “PCM”, “ Process Communication Model ” or “official PCM”, or otherwise give the impression that there is permission, sponsorship, or support from Kahler Communications;
  • claim to be able to determine or deduce someone's Basis, Phase, personality structure, or official PCM Profile;
  • generate, simulate, or mimic an official PCM Profile or an official PCM assessment result;
  • mimic or replace protected PCM tools, reports, questionnaires, certification processes, or professional feedback conversations;
  • Use PCM marks, terminology or protected material in such a way as to cause confusion regarding origin, approval or affiliation.

For each of these forms of use, a specific written license from Kahler Communications is required.

Official PCM analyses and permitted use

Only analyses produced using official PCM tools, and delivered in accordance with PCM standards by authorized PCM professionals, may be presented as a PCM assessment, PCM Profile, or official PCM interpretation.

AI may not be used to replace, simulate, or circumvent the authorized PCM questionnaire, the official profile generation process, or the role of certified PCM professionals, to the extent that consent is required for this.

Protection, enforcement and removal requests

Kahler Communications actively protects the intellectual property of PCM and may take appropriate measures against unauthorized use, including:

  • contractual enforcement;
  • summonses to cease use;
  • complaints regarding infringement of trademark and copyright;
  • requests to remove or restrict unauthorized AI assistants, GPTs, datasets, bots, applications, web pages, or other infringing material;
  • legal steps where necessary.

Major AI platforms offer reporting procedures for suspected copyright and trademark infringements. OpenAI, for example, has separate reporting channels for copyright and trademark disputes, in addition to broader options for reporting content.

Report unauthorized AI use of PCM

Have you encountered an AI tool, chatbot, GPT, assistant, online service, or dataset that appears to be using PCM's intellectual property without permission? Please report it to Kahler Communications via info@processcommunicationmodel.com , or to us via info@pcmnederland.nl . We will ensure your report reaches the right place. Please include the following information:

  • the name of the tool or service;
  • the URL or the location on the platform;
  • screenshots or examples of the suspected abuse;
  • any indications that the tool presents itself as official, licensed, or based on PCM.

Kahler Communications assesses every report and takes appropriate action where necessary.

Our commitment

Kahler Communications recognizes the potential value of artificial intelligence, provided it is deployed responsibly, ethically, and lawfully. However, AI must not be used to appropriate, copy, dilute, or misrepresent the Process Communication Model® or the protected ecosystem surrounding it.

Our goal is to safeguard the integrity, quality, and reliability of PCM for the benefit of clients, certified professionals, partners, and the global PCM community.
